Terms of Service

These Terms of Service ("Terms") govern your access to and use of all products and services operated by AVSaaS ("AVSaaS," "we," "us," or "our"), including avsaas.io and all product subdomains. By creating an account or using any AVSaaS product, you agree to these Terms.
1. Accounts and Eligibility
You must be at least 16 years old and capable of forming a binding contract to use our services. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at [email protected] if you suspect unauthorized access.
2. Acceptable Use
You may use AVSaaS products only for lawful purposes and in accordance with these Terms. You may not: attempt to gain unauthorized access to any system; use the services to transmit malware or spam; reverse-engineer or scrape the services; resell or sublicense access without written permission; or use the services in a way that violates applicable law or the terms of any third-party platform you connect.
3. Third-Party Platform Connections
AVSaaS products connect to third-party platforms (HubSpot, Shopify, Stripe, and others) via OAuth or API credentials you provide. You represent that you have the authority to connect those accounts. You are responsible for ensuring your use of the connected platform complies with that platform's terms of service. AVSaaS is not responsible for changes to third-party platform APIs that affect our product functionality.
4. Subscriptions and Billing
Paid plans are billed monthly. All prices are displayed in USD. You may cancel at any time — cancellation takes effect at the end of the current billing period. No refunds are provided for partial months. We reserve the right to change pricing with 60 days' written notice to account holders.
5. Free Tier
Free tiers are provided without warranty of any kind and may be subject to usage limits. We reserve the right to modify or discontinue the free tier with 30 days' notice. Continued use of a paid feature after the end of a free trial constitutes acceptance of the applicable paid plan pricing.
6. Data and Privacy
Our collection and use of your data is described in our Privacy Policy. By using our services, you agree to the Privacy Policy. You retain ownership of all data you bring into AVSaaS products. We process that data only as necessary to deliver the services you have configured.
7. Service Availability
We aim for high availability but do not guarantee uninterrupted service. Planned maintenance will be announced on our status page with at least 24 hours' notice. AVSaaS is not liable for losses resulting from service interruptions, including missed alerts or delayed snapshots during outages.
8. Intellectual Property
AVSaaS retains all rights to the software, design, and documentation of its products. You retain all rights to your data. Nothing in these Terms transfers ownership of either party's intellectual property.
9. Limitation of Liability
To the maximum extent permitted by law, AVSaaS is not liable for indirect, incidental, special, or consequential damages arising from your use of the services, including losses from missed alerts, incorrect projections, or third-party platform changes. Our total liability for any claim is limited to the fees you paid in the 12 months preceding the claim.
10. Indemnification
You agree to indemnify and hold AVSaaS harmless from any claims, damages, or expenses arising from your use of the services, your violation of these Terms, or your violation of any third party's rights.
11. Termination
Either party may terminate at any time. We may suspend or terminate your account for material violation of these Terms, with notice where practicable. Upon termination, your data is retained per the schedule in our Privacy Policy and then deleted.
12. Governing Law
These Terms are governed by the laws of the applicable jurisdiction of AVSaaS's operating entity. Disputes are resolved by binding arbitration, except where prohibited by law, with proceedings conducted in English.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated by email to account holders at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.
